Our Privacy Policy

This Privacy Policy outlines how we, BrainCapture ApS, collect, use, store, and protect your personal data to ensure your confidence and trust in our products and services. Your privacy and informed consent are important to us, and we want you to understand the types of data we collect, why we collect it, and how we use it.

In all cases we will comply with any applicable laws restricting the use or disclosure of your personal data.

We may revise or update this Privacy Policy from time to time, at our discretion and without prior notification, to reflect changes in our practices or for legal, operational, or regulatory reasons. 

Types of Information Collected

We provide EEG interpretation services to the registered medical practitioner who takes your EEG recording (your “Provider”). When your Provider uses our products to conduct an EEG recording, we may collect the following types of information from you:

  • The electroencephalogram (EEG) and electrocardiogram (ECG) biosignal sample data in the recording;
  • Personal information collected from the pre-recording questionnaire, such as age, gender, and seizure history; 
  • Information necessary to create and validate a unique patient ID, such as your name and a national ID or similar number. 

Legal Basis for Processing Your Data

We will not process your personal information unless you have given your explicit consent to do so. You will be asked this consent before your Provider begins your EEG.

We reserve the right, in exceptional circumstances, to conduct additional processing to the extent required by law.

Purpose of Collecting your Data

The information we collect from your EEG scan will only be used for two purposes. 

  1. We will use your information to complete the services set out in the agreement signed with your Provider. Under this agreement, we will store your EEG information in our secure servers and make it available to a professional EEG reader for interpretation; 
  2. We will retain a copy of your EEG scan that has had all personal information removed. We will use these scans for research and development purposes to improve our products and EEG services generally.

Sharing Your Data

We only collect, store, and share your data with your consent and under the supervision of your Provider. We will only ever share your information in the following specific situations:

  1. To our certified medical partners, who will access your information in order to read your scan and provide relevant annotations for your doctor.
  2. To our third-party partner who provides our data storage services in full compliance with relevant privacy and data protection laws.
  3. To third party research companies who will use scan results for scientific research and development. Before ever transferring information to these third parties, we will ensure that all identifying information has been removed from the scan.

We will not sell, share, or otherwise distribute your personal data to third parties except as provided in this Privacy Policy. We may disclose your personally identifiable information to other BrainCapture affiliates worldwide that agree to treat it in accordance with this Privacy Policy, but only in accordance with the terms of this Privacy Policy. 

Personal data may occasionally be transferred to third parties who act for or on behalf of BrainCapture, or in connection with the business of BrainCapture, for further processing in accordance with the purposes for which the data were originally collected, such as delivery services, evaluation or technical support. These third parties have contracted with BrainCapture that they will only use personal data for the agreed upon purpose, and will not sell your personal information to third parties, and will not disclose it to third parties except as may be required by law. Where such disclosure of personal data to a third party occurs, we will endeavor to ensure that the processing is performed in accordance with the purposes and within the limits under which the data were originally collected.

There are two additional instances in which personal data collected from you may be transferred to a third party. The first is in the event that the business of this site and the customer data connected with it is sold, assigned or transferred, in which case the buyer, assignee or transferee would take the personal data subject to this Privacy Policy. The second instance in which personal data may be disclosed to a third party is if we are required to do so because of an applicable law, court order or government regulation, or if such disclosure is otherwise necessary in support of any legal or criminal investigation.

Security

The security of your data is important to us. BrainCapture and our partners implement and maintain appropriate measures to protect your personal data. These security measures are compliant with GDPR, HIPAA, and HITRUST.

Transferring and Storing Your Data

In order to provide our services, we may need to transfer your personal data to servers located in other countries. We will always ensure that the necessary safeguards are in place to protect your data in accordance with industry standards and with all applicable laws.

Your Rights

  1. You have the right to not consent to the processing of your information. If you choose not to consent, your Provider will not utilize our services and may not proceed with the EEG scan.
  2. You have the right to withdraw your consent at any time. You can do so by contacting us at compliance@braincapture.dk.

Retention of Your Data

We will only process or retain your data for as long as it is necessary to complete the services requested by your Provider and to satisfy any legal, regulatory, accounting, or reporting requirements. Once these requirements are completed, we will either delete your data or anonymize it so that all identifiable markers have been removed. 

Personal Data and Children

We will not knowingly collect, use or disclose personal data from a minor under the age of 18 without obtaining prior consent from a person with parental responsibility (e.g., a parent or guardian). We will provide the parent with (i) notice of the specific types of personal data being collected from the minor, and (ii) the opportunity to object to any further collection, use, or storage of such information. We abide by laws designed to protect children.
